Terms of Service

1. About Kalyaki & these Terms
Kalyaki is a tablet learning app for children ages 3–8 that lets them draw, learn words, and practise saying them with on-device AI guidance. Kalyaki includes the mobile application (referred to in these Terms as “the app”) and the website at https://kalyaki.com (referred to as “the site”). Together, the app and the site are “the service”.
The service is operated by Egor Sharapov, a Sole Professional licensed by the Dubai Development Authority (Sole Professional License No. 107100), registered at Building 16, Ground Floor, Dubai Internet City, Dubai, United Arab Emirates. Throughout these Terms, “we”, “us”, and “Kalyaki” refer to the operator.
These Terms govern your use of the service. The Privacy Policy at https://kalyaki.com/privacy is incorporated into these Terms by reference.
2. Acceptance
By downloading, installing, opening, or using the app, or by visiting the site, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the service.
3. Eligibility & parental consent
Kalyaki is designed for children ages 3–8 and is intended to be used under the supervision of a parent or legal guardian.
If you are a parent or legal guardian, you accept these Terms on behalf of your child and confirm that:
- you are at least 18 years old;
- you have the legal authority to enter into these Terms on behalf of the child;
- you have read and understood the Privacy Policy and consent to Kalyaki’s processing of your child’s data as described there;
- you will supervise your child’s use of the service.
Children may not accept these Terms on their own. If you are under 18, please ask your parent or legal guardian to read and accept these Terms before you use Kalyaki.
4. License to use the app
Subject to your compliance with these Terms, Kalyaki grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on devices you own or control, for personal, non-commercial purposes.
You do not acquire any ownership rights in the app, the site, or any of their components. All rights not expressly granted to you under these Terms are reserved by Kalyaki and its licensors.
5. Acceptable use
When using the service, you agree not to:
- copy, modify, reverse-engineer, decompile, or attempt to extract the source code, machine learning models, or any other proprietary component of the app or the site;
- redistribute, sublicense, sell, rent, or lease the app or any part of it;
- attempt to access, identify, or re-identify another child’s profile or drawings;
- interfere with or disrupt the operation of the service, including by uploading malicious files or attempting to overload our servers;
- use the service for any unlawful purpose or in violation of these Terms or the laws of the United Arab Emirates or your country of residence;
- circumvent any technical measure, including the in-app parental gate, that limits access to particular features.
6. Children’s drawings & content
Drawings created in Kalyaki belong to the child and their parent or legal guardian. Kalyaki does not claim ownership of any drawing.
By using the app, the parent or legal guardian grants Kalyaki a perpetual, worldwide, royalty-free, non-exclusive license to use the drawings uploaded from the device, together with the limited profile metadata described in the Privacy Policy, to train and improve Kalyaki’s on-device drawing-recognition models and related machine learning components.
Kalyaki will not:
- sell drawings or profile metadata to any third party;
- display individual drawings publicly in a way that identifies a child;
- share drawings or profile metadata with advertisers, data brokers, or analytics providers.
This license is independent of any deletion of the local profile in the app. See the Privacy Policy (“Retention & deletion”) for what happens to server-side records when a parent deletes a profile, and how to request server-side deletion.
7. Intellectual property
The Kalyaki name, the Malyaka mascot name and likeness, the logo, the illustrations, the app and site visual design, and all related content are the property of Egor Sharapov and are protected by United Arab Emirates and international intellectual property laws.
The word vocabulary used by the app’s Learn and Play modes (the 39-word “Learn” set and the 345-category “Play” set) is derived from the publicly released Google Quick, Draw! dataset, used under the Creative Commons Attribution 4.0 International License.
8. Third-party software & licenses
Kalyaki incorporates the following third-party components:
- Hegel Pro typeface by Reghardt, licensed via Envato Elements (Item ID
XQVVMA, license codeXJHF75L4S3). - Inter Tight typeface, served via Google Fonts under the SIL Open Font License 1.1.
- Google Quick, Draw! dataset (categories list), licensed under the Creative Commons Attribution 4.0 International License. Source: Google Research.
- Open-source software libraries including Astro, React Native, Expo, and other dependencies. A current list is available on request via

All third-party components remain the property of their respective owners and are used under the terms of their respective licenses.
9. In-app purchases, class codes, and free access
Kalyaki includes a free Starter bundle (the Animals word pack) and optional one-time, non-consumable in-app purchases (such as the Creator Pack, which unlocks the Food, Objects, Things, and Nature word packs). Payments are processed by Apple through the App Store; we receive a record of each purchase from our purchase-processing partner, Adapty, so that we can grant the corresponding entitlements on your devices. We do not receive your payment-card number or other payment information.
Kalyaki also offers class codes issued to schools and educators who license Kalyaki for classroom use. A parent, teacher, or school administrator can enter a class code in the app’s Settings (“School Access”) to unlock the corresponding bundle for the device’s profile. Codes are validated by our server, consumed on first use, and grant the same entitlements as the equivalent App Store purchase. Class codes do not entitle you to a refund of any previous in-app purchase.
Prices, available bundles, class-code pricing for schools, and the inventory of paid features may change. Material changes will be reflected in these Terms with reasonable notice.
10. Disclaimers
The service is provided “as is” and “as available”, without any warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, Kalyaki disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.
Kalyaki does not warrant that the service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the service or the servers that make it available are free of viruses or other harmful components.
Kalyaki makes no representation regarding any specific learning, educational, or developmental outcomes for any child using the service.
11. Limitation of liability
To the maximum extent permitted by applicable law, Kalyaki, its operator, and its service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with the service, regardless of the legal theory of the claim (contract, tort, statutory, or otherwise) and whether or not we have been advised of the possibility of such damages.
In any event, Kalyaki’s total aggregate liability arising out of or in connection with the service shall not exceed the greater of (a) the amount you paid for the service in the twelve months preceding the claim, or (b) one hundred United Arab Emirates Dirhams (AED 100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities, so some of the above limitations may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Kalyaki and its operator from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- your breach of these Terms;
- your misuse of the service;
- your violation of any law or regulation, or any third-party right, in connection with your use of the service.
13. Termination
Kalyaki may suspend or terminate your access to the service at any time, without notice, if you breach these Terms or use the service in a way that creates a risk for the service, other users, or Kalyaki.
You may stop using the service at any time by uninstalling the app and deleting your profile. The in-app “Delete Account” option wipes local profile data. See the Privacy Policy for what happens to server-side records and how to request their deletion.
Sections 6 (Children’s drawings & content), 7 (Intellectual property), 10 (Disclaimers), 11 (Limitation of liability), 12 (Indemnification), 15 (Governing law & disputes), and 16 (Contact) survive any termination of these Terms.
14. Changes to the Terms
We may revise these Terms from time to time. The “Last updated” date at the top of this page tracks revisions. Material changes — such as changes affecting the license you grant in Section 6, the limitation of liability in Section 11, or the governing law in Section 15 — will be highlighted on the website and, where reasonable, surfaced in the app at least 14 days before they take effect.
By continuing to use the service after revised Terms take effect, you accept the changes. If you do not accept the revised Terms, stop using the service.
15. Governing law & disputes
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the United Arab Emirates, without regard to conflict-of-laws principles.
Any dispute, controversy, or claim arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the Courts of Dubai, United Arab Emirates. Nothing in this section prevents Kalyaki from seeking injunctive or equitable relief in any other court of competent jurisdiction.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
